That title is decades in the making, and what a victory that would be for the millions of unborn children that would get a chance at life. However, this decision is only a draft decision – no ‘published’ decisions have been made, yet. Regardless, the draft shows what the majority of the court is thinking.
That said, let’s examine; Justice Alito wrote a draft opinion regarding the landmark abortion cases of both Roe and Casey. The justice exclaims, “We hold that Roe and Casey must be overruled.”
Now, this decision could change – it has not been published. However, the draft was circulated within the High Court, and Politico obtained a leaked copy. According to Politico, a final, published decision could be on the cards within the next two months.
The immediate impact of the ruling, as drafted in February, would be to end a half-century guarantee of federal constitutional protection of abortion rights and allow each state to decide whether to restrict or ban abortion. It’s unclear if there have been subsequent changes to the draft.
No draft decision in the court’s modern history has been disclosed publicly while a case was still pending. The unprecedented revelation is bound to intensify the debate over what was already the most controversial case on the docket this term.
